STEP 1: FREE NO OBLIGATION CONSULTATION

At your Free No Obligation Consultation we take a look at your income, assets, expenses, and debts to try and figure out if bankruptcy is the best solution to your unique situation. STEP 2: REVIEW AND SIGN MEETING

Between the Free No Obligation Consultation and Review and Sign Meeting, we don’t send you home with any worksheets. We do all the work for you! Instead, we pull your credit report and ask you to bring a few documents that are easy for you to get your hands on: paystubs, tax returns, vehicle titles, etc.

At your Review & Sign Meeting, you meet with our staff and your bankruptcy attorney to discuss the details of your bankruptcy petition. We go through a draft of your bankruptcy petition and schedules to make sure the information included is true, correct and complete. At the end of the meeting, you sign your bankruptcy petition and we file your bankruptcy within one to two days!

As soon as our MN Bankruptcy Lawyers file your bankruptcy petition and schedules, creditor collection must stop by law. The relief you are seeking begins here! You should already feel a weight lifted off your shoulders!

STEP 3: 341 MEETING

Your 341 Meeting is also known as the “First Meeting of Creditors.” While creditors are invited to attend your 341 Meeting, they rarely are in attendance. At this meeting, your bankruptcy attorney and you sit with a bankruptcy trustee while they ask you “yes or no” style questions regarding your bankruptcy petition and schedules. They are just checking to see that the information included in your bankruptcy petition and schedules is true, correct and complete. The 341 Meeting averages only 5-10 minutes, is not in a courtroom, and is not with a judge. It is an important and mandatory, yet informal meeting with the bankruptcy court.

Note: In a Chapter 13 bankruptcy, there is STEP 3.5: CONFIRMATION HEARING.

Following the 341 Meeting, a Confirmation Hearing is scheduled in a Chapter 13 case. Usually, you are not expected to attend and your bankruptcy attorney attends on your behalf. At the Confirmation Hearing, the court approves the repayment plan you proposed in your bankruptcy petition. STEP 4: DISCHARGE

If you filed a Chapter 7 bankruptcy, you will receive your Notice of Discharge approximately 60 days after your 341 Meeting. If you filed a Chapter 13 bankruptcy, you will receive your Notice of Discharge after your 3-5 year plan payments are complete.

The Notice of Discharge means that your qualifying debts have been discharged. Congratulations! Relief at last!
